Captain Hoffman,
Since May of 2015 I have requested to make a Citizen's arrest per common law and WA State precedent and the Bellevue Police refuse to respond. Please respond within 72 hours to the following questions  or provide a response as to why the Bellevue police refuse to investigate crimes in their jurisdiction.
1) What is the status of the criminal investigation of Felony Assault committed by Bhavpreet Bhamber? 
2) What is the status of the criminal investigation of Perjury by both Bhamber brothers?
3) What is the status of the investigation into the conduct of Officer Peacey?
4) What is the status of the investigation into the conduct of Officer Wyche?
5) What is the status of the investigation into the conduct of Captain Hershey?
6) Who is the Detective assigned to investigate my criminal allegations of any and all suspects NOT including Deputy Chief Jolliffe?
The police are obstructing the criminal case by not investigating or referring to the County prosecutor. I have always stated I was willing to aid in prosecution of the Bhamber's.
Why exactly do police have special rights?
This unequal protection under the law in unconstitutional and I don't know what you expect me to do about it other than use the legal system as it was intended. 
I can and will do so, only because I am left no other option owing the disgraceful actions of the police and prosecutors in Bellevue.
What an incredible waste of time to keep trusting the Bellevue police. 
Every day I have to decide how much more I can take.
This is how an innocent native US citizen is treated in their State of residency?
This is what you call serving the public?
Too bad the taxpayers pay out for your misconduct, there really is no winner here.

Subject: Case no. 15-24001: Results of Civil Trial and Request for review of Criminal Charges
Captain Hoffman,
I appreciate your help immensely. I received the court decision hours before I heard the news about Jolliffe, and at the time, had not read the decision correctly. 
The case was dismissed, but without prejudice. 
Because the Bhamber's lied in court, and because the police reported the facts of the case incorrectly, I was unable to prove my case without the video evidence. Judge Nault refused to watch the video to confirm or disprove his own decision. 
I will be refiling in Superior court but there is something I need to address still.
I can't say I am happy about running into this problem again and again, when a detailed analysis of the video completely exonerates me yet is denied by officials.
What really gets me, is people tell me my evidence proves the opposite of what I say -- while refusing to watch the video.
No probable cause for the charges could be argued existed that day unless one is a biased and deficient in their decision making process, as OFC PEACEY was.
I had a camera, not a weapon. I used my words, not my fists, even after I was beaten to the ground. I had faith the police would help. 
Now I know better and believe me I wish I didn't.
I request a criminal investigation into this matter, a REAL one with video analysis and transcripts made, questions asked, witnesses interviewed, full statements taken. 
You can see the consequences of the police's actions with the compromising of my civil case, let alone a criminal case. Crimes were committed. Felony crimes under RCW, and for which I have power under common law and State precedent to perform a Citizen's arrest. 
I have attempted to find a competent official to complete the arrest without success since May.
To wit,
The actions by B. Bhamber occurred in violation of
RCW 9A.36.021 - Assault in the second degree; (for choking me)
RCW 9A.40.040 - Unlawful imprisonment; (for restraining me)
RCW 9A.36.041 - Assault in the fourth degree; (for hitting me for no reason multiple times)
RCW 9A.36.050 - Reckless endangerment; (hitting me to the ground, driving straight at me)
RCW 9A.48.090 - Malicious mischief in the third degree; (for throwing my shirt away from me after choking me)
RCW 9A.46.020 - Harassment; (for filing a false report with intent to defame me and for actions after the assault, for throwing my shirt, for continued noise violations after assault)

RCW 9A.36.050 - Reckless endangerment; (for encouraging his brother to assault me by restraining me and being aggressive)
RCW 9A.84.030 - Disorderly conduct; (for starting a fight)
RCW 9A.46.020 - Harassment. (for filing a false report with the intent to defame me, and continuing to falsely swear against me)
RCW 9A.72.040 False swearing.(and felony Perjury in the 2nd Degree)
Please let me know when someone besides OFC WYCHE, OFC PEACEY, CPT HERSHEY, or LT MCELYEA gets to rule that there is no evidence for a criminal case. 
This needs to be assigned to a detective and I am requesting that be done. I feel I am in danger now that the Defendants will be emboldened by the lower Court believing their lies. 
This is not right and I will have to work hard to fix it. Let's get started.

You are not in compliance with the complaint policy.
Everyone keeps telling me only Bellevue police have jurisdiction over the Bellevue police, yet you refuse to investigate. What am I left with for options? Do you really not understand what you're doing?
FOR THE 5th TIME:
Who is the Detective assigned to investigate my serious misconduct complaints and complaints of criminal conduct?
It's all documented what you're doing, LT INGRAM. 
Your delays have caused harm any reasonable person could foresee, let alone a police officer trained and sworn to uphold the law. This is willful and malicious and I will not stand for it.
Why does the Sheriff's Office have their own oversight auditor, yet Bellevue PD can break the law at will and NO ONE has jurisdiction to stop them except the Federal Government and injunctive relief from the courts?
Stop breaking the law and starting upholding your oath.
I am done asking nicely. From now on, I will be telling you, and you will comply or face the full consequences of your actions in Superior or even Federal court. There is no immunity left for the BPD.

Lt. Ingram,
Since my complaints implicate the Office of Professional Standards and the Office of the Chief, I am requesting an outside agency investigate this matter.
The "Office of Professional Standards" is not a person to whom I can speak. 
I do not want any of my complaints investigated by yourself, PIO Tyler, Captain Hoffman, or anyone from the Chief's Office or administration. 
This "office" has violated policy and can not be considered impartial owing the severe delay in investigation.
The complaint policy states,
"When the complaint is received by mail, email, website, or fax, the complaint should be forwarded to the Office of Professional Standards for initial review. 
The Professional Standards Lieutenant will promptly notify the person making the complaint that it has been received and the name and contact numbers of who is responsible for handling the complaint."
Only a DETECTIVE that I have never spoken to will be even remotely acceptable in this instance. This should be a DETECTIVE in the INVESTIGATIONS unit. 
I would like THE NAME of this PERSON.
I should not have to explain why at this point.
It would be far better in the interests of impartiality to get another agency to investigate as Bellevue PD has done before.
I expect to be contacted within the week with the information I requested above.
I have rights and a cause of civil action under Federal and State Law -- I remind you because that course of action exists as the singular alternative being presented to me by the Bellevue police department and King County.
I don't want to waste any more time or taxpayer money, and I fail to see why a reasonable person would. Please act accordingly.

I am writing to express concern for the lack of social media comment policies on the Bellevue Police facebook and twitter accounts. Neither account is in compliance with the stated City policies found here: http://bellevuewa.gov/pdf/Manager/Website_Policies_and_Procedures.pdf 
To wit:
"MODERATION
While visitors to social-media sites hosted by the City of Bellevue can post  content directly on some Bellevue social media pages, the content must  comply with Bellevue guidelines, being essentially free of libel, profanity and harassing attacks."
"A comment policy stating what kinds of comments are unacceptable will be  posted on all social media pages. "

are in direct violation of the City of Bellevue Social Media policy on moderation.
There is NO comment policy provided on either page nor a reference to public records statutes.
As of November 2nd 2015, and for at least a period between May 2015 and November 2015, there has been no posted policy.
The moderation of comments took place against direct criticisms of the department, not slander nor libel.
Harassment is not something the City of Bellevue Police can "protect" themselves from in an Official capacity when it is a Citizen dissenting in a  public forum.
 This phrasing can only apply to interactions involving other Citizens and already encompassed by existing anti-harassment law.
Proof of the specific violations is attached in the form of screenshots.
This is a First Amendment violation, and a clearly established pattern and practice of the Bellevue Police Department, in violation of the US and WA State Constitutions.
The City of Bellevue Police Department will Cease and Desist such actions that include, but are not limited to, removing comments or blocking accounts, until such time as a fair and clear Comment Policy is established and posted, providing that policy does not violate superceding laws.
A Comment Policy will also address the Public Records Act in a manner  similar to other King County Law Enforcement Agencies, which provide a  disclaimer that:
 "Comments, list of followers subject to public disclosure (RCW 42.56)."
Please unblock any and all accounts within 48 hours, including specifically but not limited to unblocking my ability to comment on posts.

Good evening, Mr. D-- I understand that you disagree vehemently with the conclusions of the police and the prosecutors in this situation.  In our system of justice, those are the decisionmakers about criminal referrals and criminal filings.  As an elected official, I am not empowered to tell police or prosecutors who to charge with a crime and who not to charge with a crime --- even if I felt they had made a mistake, which I do not in this case.  I agree with you completely that the courts are the appropriate recourse for you to raise your complaints that your rights have been violated.  I encourage you to seek out legal help and to file your claim with the courts so that a neutral party can review the claim and make an appropriate decision.  I think that will be the healthiest way to resolve this ongoing dispute and I welcome this approach as it seems to be the only path to a resolution.

I am going to compel all of you to testify in court so I understand you can't tell me any more lies or placations at this point. You've done enough damage in that regard. It hasn't helped that you simply stopped responding in the hopes I would go away -- perhaps thinking that was a chance of being fiscally responsible if not morally responsible. The City may be incorporated but you still must follow the law and obey the State and US Constitutions. I have nearly finished my Summons and Complaint against the City of Bellevue and responsible named parties in their individual capacity. I will serve and file in early November. This will all be in a court of record soon for every Citizen to see the injustice you and the Bellevue Police have personally done to me.

Since you have so many on staff, ask the ex-military personnel what kind of response such a reply would illicit regarding a query from a superior.
The answer to a citizen requesting law enforcement about a situation of which you are unsure about how to proceed is:
"This officer does not know, but will find out (Mr. D)"
Not boding well for our citizens when every LEA cannot answer a simple question of protocol because the scenario is one they refuse to acknowledge. 
You do not get to choose what laws you wish to enforce, or what reality you wish
What would you do if you were me?

I appreciate your response, but why does no one have to enforce the law? What do I do? John Urquhart just fired two deputies for the same thing. Now, the BPD has done the exact opposite.You know you are not the agency, which means you know you(sic) is. Please tell me.This is not legal counsel I seek from you, this is public information you appear to have. I desperately need it; Please reveal where I may go to report a crime when I already reported the crime and the police refused to take the report, then the police refused to investigate themselves -- these are the actions of a criminal conspiracy and not a law enforcement agency! I have reported the agency itself, but what about the crime that was committed? The assailant was never charged! Who will charge him if not the police?? The prosecutors cannot act without your agencies.
Total honesty happens to keep Officers in the job, and that appears to be a change meeting resistance to those that exercise discretion for personal gain.
It's a new era for law enforcement. Please help me.
