Hoffman also let Seth Tyler, PIO, get my Twitter accounts suspended for a while, then tried to say I impersonated an officer - a felony they never reported to anyone except their lawyer defending against my lawsuit...for this?? a PARODY account...

I am writing to express concern for the lack of social media comment policies on the Bellevue Police facebook and twitter accounts. Neither account is in compliance with the stated City policies found here: http://bellevuewa.gov/pdf/Manager/Website_Policies_and_Procedures.pdf
To wit:
"MODERATION
While visitors to social-media sites hosted by the City of Bellevue can post content directly on some Bellevue social media pages, the content must comply with Bellevue guidelines, being essentially free of libel, profanity and harassing attacks."
"A comment policy stating what kinds of comments are unacceptable will be posted on all social media pages. "

are in direct violation of the City of Bellevue Social Media policy on moderation.
There is NO comment policy provided on either page nor a reference to public records statutes.
As of November 2nd 2015, and for at least a period between May 2015 and November 2015, there has been no posted policy.
The moderation of comments took place against direct criticisms of the department, not slander nor libel.
Harassment is not something the City of Bellevue Police can "protect" themselves from in an Official capacity when it is a Citizen dissenting in a public forum.
This phrasing can only apply to interactions involving other Citizens and already encompassed by existing anti-harassment law.
Proof of the specific violations is attached in the form of screenshots.
This is a First Amendment violation, and a clearly established pattern and practice of the Bellevue Police Department, in violation of the US and WA State Constitutions.
The City of Bellevue Police Department will Cease and Desist such actions that include, but are not limited to, removing comments or blocking accounts, until such time as a fair and clear Comment Policy is established and posted, providing that policy does not violate superceding laws.
A Comment Policy will also address the Public Records Act in a manner similar to other King County Law Enforcement Agencies, which provide a disclaimer that:
"Comments, list of followers subject to public disclosure (RCW 42.56)."
Please unblock any and all accounts within 48 hours, including specifically but not limited to unblocking my ability to comment on posts.

I will be checking to see if my accounts are unblocked, or have received a message referring to a comment policy which was violated, including the exact words used and why they are unacceptable in the absence of any comment policy.
The State may not decide it is being harassed and decide to arbitrarily silence select voices without any due process concerning freedom of speech.

This is an establish pattern and practice of the City of Bellevue and the City of Bellevue Police Department.

The Facebook page mentioned above has NO comment policy. My comments were removed despite not violating current City of Bellevue policy on Slander, Libel, and Harassment, which are the ONLY conditions allowing for moderation. No notice of any violations was sent to any user account.

has blocked my twitter account [USER @BPDmisconduct] from Viewing [USER: @bvuepd] emergency notifications, and from sending messages to @bvuepd.
This is a violation of my first amendment right to freedom of speech and right to redress my government in a peaceful manner regarding my grievances.
I demand the City of Bellevue Cease and Desist violating my civil rights and unblock the following accounts:

PIO Seth Tyler will now be named in his individual and official capacity for
violations of my 1st amendment right in a civil action naming the City of
Bellevue, et al, for the continued pattern and practice of civil rights
violations, including the 1st and 14th amendments, and violations of Federal
and State law.
This may also be considered a Formal Complaint of Serious Misconduct against
this Officer, whose actions have violated City Policy and my Civil Rights.
This is not a debate, I have attached proof and demand an answer from an
investigator who is from the Internal Office of Professional Standards
(which Seth Tyler is part of...well, I guess there goes that option). Again,
no civilian oversight or ANY oversight of the Bellevue Police Department per
City of Bellevue Policy has caused grievous harm
This conspiracy against my civil rights will be answered for in King County
Superior Court in a jury trial.
Compliance with City of Bellevue Social Media Policy is still required. To
date, my social media accounts have been blocked without due process.
The City of Bellevue will cease and desist violating my constitutional and
civil rights and respond that they have applied all necessary remedy to the

I have also contacted the manager for the City of Bellevue mediation program. I will be able to provide more details about setting a date for mediation between you and police department representatives regarding your previous complaints about Officers Peacey and Wyche and Captain Hershey early next week. I ask for your patience as I facilitate this process for you.

So I added the Twitter part into my lawsuit against the City and police... I'm a bad lawyer. Theirs was much much better. The mediation meeting I had with Hoffman in December was frustrating. I showed him the police statements where they clearly state they are describing a video THEY REVIEWED MORE THAN ONCE ... but that didn't match the video. Not the words. Not the actions. So I wanted him to say Yes or No, did what the Officer write, just happen on the video I just showed him.
"uh huh" he said. i stared at him as he then tried to say something else... then i left the room while he stayed with my mom. He tried to come shake my hand after. I refused, just like I refused the apology of the assailants brother and the statements of the police.
Their attorney hired for the police was a great third party lawyer. He kicked my ass, figuratively speaking.
I think Melissa Chin, Police Legal Advisor from City Attorney's dept. filed a declaration that flat out lied to puff up a claim of making some kind of illegal twitter account!? That's the opposite of what happened.
but later it was a parody account .. ?
So were they Fake? Impersonations? Parodies? Rogue?
They also forgot to look up the laws they cited.. and forgot Public Officials can't be harassed by 1st amendment protected activity... that wouldn't make sense now would it??:
(b) Pretends to be a representative of some person or organization or a public servant and does an act in his or her pretended capacity with intent to defraud another or for any other unlawful purpose.
Criminal impersonation in the second degree.
(1) A person is guilty of criminal impersonation in the second degree if the person:
(a)(i) Claims to be a law enforcement officer or creates an impression that he or she is a law enforcement officer; and
(ii) Under circumstances not amounting to criminal impersonation in the first degree, does an act with intent to convey the impression that he or she is acting in an official capacity and a reasonable person would believe the person is a law enforcement officer;

See? They made shit up just to try and punish ME for not accepting their lies. This was before Trump got elected. It doesn't seem so abnormal now but it did to me in the suburbs... so now I know too much.
They found out Bellevue had no reason to complain about my account and should have contacted me -- which was the City social media policy, if you KNOW who to contact. They didn't. It was easier to lie.
*** Now, you can't block citizens Twitter accounts if you're a public official. ***
I had to send multiple cease and desists, and finally every one from City / County / State honored them.. including again in 2020 when Jen S Robertson and Jared Neweinhaus blocked me again.
Someone already sued Trump but they forgot. That case already won on Federal appeal.
President Trump has been violating the Constitution by blocking people from following his Twitter account because they criticized or mocked him, a federal appeals court ruled on Tuesday.
The ruling could have broader implications for how the First Amendment applies to the social-media era.
