Statement by Officer Christopher Wyche (P485)

THE FOLLOWING OCCURRED IN THE CITY OF BELLEVUE, COUNTY OF KING, STATE OF WASHINGTON (Ofc. Christopher Wyche):

On 05/1 9/15 I was dispatched to a disturbance at REDACTED. 
The call stated that there was a fist fight between three males. 
The parties were currently separated and at their respective homes.

Upon arrival I contacted, CD, and ZD at their home located at REDACTED.
CD stated the following. He has been recording his neighbor drive thru
a nearby stop sign and play disruptively loud music for the past few days.

Today he decided to confront his neighbor, B. Bhamber, while B. Bhamber was in his vehicle at the stop sign. CD stated he went to B. Bhamber's car with a camera and began questioning him about his poor driving practices.

B.Bhamber then exited the vehicle and smacked the camera in CD's hands.
CD stated that is when his brother ZD came onto the scene and attempted to keep both parties separate.

CD then stated that is when B. Bhamber called his brother, Jaspreet Bhamber out.
CD stated B. Bhamber was aggressing towards him and pushed ZD's arm out the way.
B. Bhamber then took CD down to the ground and placed him in a chokehold.
Jaspreet then attempted to grab CD legs, but ZD struck B. Bhamber in the head which caused him to let go.

CD stated he had video of the entire event.

CD then showed me the video.

The video showed the following.

CD approaching B. Bhamber's vehicle from the front, impeding his progress, yelling at B. Bhamber for driving through the stop sign and playing loud music.

B. Bhamber appears confused, exits the vehicle and tells CD to stop recording.

CD remains in close proximity to B. Bhamber and continues to record and question him.
B. Bhamber then pushes the camera away.

CD then yells at B. Bhamber not to touch him and slaps him in the head.
ZD comes out and attempts to separate the parties.

While ZD is separating the parties CD continues to antagonize B. Bhamber and tells him he slapped him for touching him.

Jaspreet then arrives on scene and attempts to mediate along with ZD.
CD then threatens to hit Jaspreet in the same fashion he hit his brother if Jaspreet comes closer.

B. Bhamber then pushes ZD's arm away from him and approaches CD.

The camera then becomes obstructed by the tussle and nothing is witnessed until approximately 30Seconds later when he camera is picked back up by
CD who begins to yell at B.Bhamber that he is going to jail.

B. Bhamber states he was acting in self-defense.
I asked that CD provide me with a copy of the video.
CD provided the video to Officer White.
I then asked Zachary for his account of events. ZD stated that he came out to separate his brother and B. Bhamber, but B. Bhamber kept aggressing towards CD because he was "looking for a fight".
He stated that B. Bhamber then pushed his arm and attacked his brother CD.
B. Bhamber placed CD in a chokehold and he was worried for Christian's safety, so he elbowed B. Bhamber in the head to get him to let go.
ZD went on to describe the choke hold as B. Bhamber having his arm along the cheek bone of CD. ZD made a point to state that his arm was an inch away from his carotid artery.
ZD stated that it appeared that Jaspreet was trying to grab CD's legs to aid in B. Bhamber choking him.
B. Bhamber let go after being struck and all parties returned to their homes.

I then informed ZD and CD that I would contact Jaspreet and B. Bhamber before deciding on a course of action.

I then requested that both ZD and CD complete witness statements.

I then contacted B. Bhamber outside his residence.

B. Bhamber stated the following.

He was just driving his vehicle when CD walked up to his vehicle aggressively and began yelling at him.
B. Bhamber exited the vehicle to figure out what was going on.
B. Bhamber said he pushed CD's camera to get move it away from B. Bhamber.
He then said that is when CD slapped him In the head.

B. Bhamber stated that once ZD came out he felt like he was outnumbered two against one, so he called his brother outside for assistance.

B. Bhamber stated that CD was yelling at him and threatened to
slap his brother Jaspreet when he came outside.
B. Bhamber stated that CD continued to threaten him and his brother so he fought back.

B. Bhamber stated that the exact details of the altercation he does not remember.

I then contacted Jaspreet.

Jaspreet stated the following.

He heard yelling outside so he went to see what was happening.
He witnessed CD and B. Bhamber arguing.
Jaspreet stated he went to try and separate the parties, but CD continued to yell and curse.
Jaspreet stated CD threatened to smack him.

Jaspreet then stated that B. Bhamber and CD ended up on the ground but he is not sure how.

Jaspreet stated that he then tried to separate the CD and B. Bhamber by pulling the parties apart.

B. Bhamber then let go and the parties separated.

Jaspreet stated he was sorry for the day's events and wished to apologize to CD and ZD for the altercation.

Officer Peacey and I then walked with Jaspreet back to the residence of CD and ZD.

I contacted CD and ZD and informed them that Jaspreet was outside and wanted to apologize.

Jaspreet attempted to apologize, but CD was still highly upset.

CD started cursing at Jaspreet about his brother's poor driving habits.

I then advised Jaspreet he should return home and I would re contact him later.

I then provided CD with a case number and my information.

I informed CD that based on what I had determined today that no one would be taken into custody but I would write up a report and forward it on to the prosecutor.

I then used department issued iPhone to take photographs of CD's injuries.

I later transferred the photos to a CD.

I did not alter, edit or change the photos in any way prior to transferring them on to the CD.

I booked the CD into evidence as item CJW-Ol.

I later deleted the original photos from my device.

I then re contacted Jaspreet and B. Bhamber and asked that they provide me with witness statements as to their account of events.

I provided Jaspreet with a case number and my business card and informed them that I would write a report and forward it to the prosecutor.

I then cleared the call.

Based on the video, the statements and demeanors of the parties involved, and the fact that CD at no time ever attempted to contact B.Bhamber or his family in a cordial manner about his concerns prior to the altercation, I have determined that CD will be charged with harassment and disorderly conduct.

After reviewing the video and the facts of the case, I have determined that

CD will be charged with harassment and disorderly conduct.
