Hello,

I spoke with Jeff Tory at the Bellevue City Attorney's office on Tuesday,
June 9th 2015, and he informed me he now has a request in to the Bellevue
Police Department for more information on this case. The case appears online
under a crime mapping utility with a description of "Disorderly Conduct",
which the Senior Officer threatened to charge all parties involved with.

At the time of the incident, I insisted I had been seriously assaulted, had
my injuries documented, and filled out a sworn statement given to the police
in person during their visit (despite the Senior Officers attempt to leave
without it).In addition, I have a full first person video of the incident
proving what I claim is true.

The Senior Officer told me to "Shut up" and that she "was done with me" and
my brother and i can "mail in statements".

Of the 4 officers present, 2 watched the video. Of those 2, only Officer C.
Wyche inquired whether we (my brother and I) would aid in prosecution, which
we affirmed. My brother was a victim of battery on the video.

I believe the Senior Officer (Peach?) made an error and was unwilling to
correct it in front of her peers, due to her misunderstanding of the 2-party
consent law. She also made several sexist comments in the presence of my
brother, which he and my mother will testify to. It appears she essentially
considers any fight between males to be mutual combat; that was not the case
here, nor do I think that is a healthy attitude for a police officer to
have.

I do not know why the police have not finished with the case, when it was
stated the day of the incident by the Senior Officer that the investigation
was going to continue at a prosecutor's office. I believe the officer may be
using administrative delays to obstruct this case and avoid questions about
her conduct; no one has contacted me or my brother requesting any
information.

How long do the police have to forward a case, if they cannot decide what
charges, if any, should be filed? Again, I am willing to assist in any
prosecution of this juvenile suspect.

Assault in the second degree.
(1) A person is guilty of assault in the second degree if he or she, under
circumstances not amounting to assault in the first degree:
(e) With intent to commit a felony, assaults another; or
(g) Assaults another by strangulation or suffocation.

I was being choked unconscious via blood restriction and oxygen deprivation,
after the suspect had knocked the camera out of my hands and struck me with
a closed fist in the left side of the head above my ear.

His blow disoriented me completely and I was on the ground when he recovered
his momentum and grabbed me from behind to assault me again. In my written
statement I even say I do not know who struck me.. only after speaking with
my brother and watching the video could I piece things together. The Senior
officer certainly did not go even this far.

Striking someone over concrete with a closed fist could have resulted in
serious injury or death. Choking me, the same.This use of deadly force was
unwarranted and only stopped after the very restrained and well communicated
directive from my brother to cease or face harm.

I applaud my brother for his restraint and regret ever having put him or
myself in such a situation. That does not excuse the violence and the Senior
Officer's conduct.

I had to call the police on May 22nd, the Friday after the assault, because
the juvenile suspect was harassing me by driving by, revving his engine and
blasting music. I have several instances on video, including him running the
stop sign again. I kept a log of incidents which stopped for a period when
the juvenile suspect apparently left the area. Now I see him on crutches,
and I suspect the ferocity of his attack actually resulted in an injury to
his knee because of his size.

Jeff Tory states he prefers not to email, and when I emailed the Bellevue
Police I got a call back from an Officer McElia (McElyea?) where he left a
message with my brother saying I "wasn't going to like what he had to say".
I really prefer not to communicate verbally at this point unless there are
witnesses.

Your office is the only one who has responded promptly (I never received a
response from my email to the Bellevue City Attorney via their reception).
